1. Scope
These General Terms and Conditions (AGB) apply to all offers, contracts, services, and deliveries provided by SCSplastic. Deviations require prior written agreement. By placing an order, the customer accepts these terms.
2. Nature of Business
SCSplastic operates as a project-leading service provider, coordinating the development, production, and delivery of plastic components through trusted manufacturing partners. SCSplastic does not act as the physical manufacturer unless explicitly agreed.
3. Tooling and Ownership
All tools, molds, and design data remain the property of the customer, even if stored at a partner factory. SCSplastic ensures appropriate storage and care but is not liable for natural wear, loss, or damage by third parties. After 12 months of inactivity, tooling may incur storage or maintenance fees.
4. Delivery & Deadlines
Delivery times are non-binding estimates. Delays caused by force majeure, factory shutdowns, supplier issues, or logistics disruptions do not justify claims. SCSplastic will actively assist customers in resolving such issues with suppliers.
5. Pricing
All prices are net, excluding VAT, customs, and transport, unless otherwise stated. Prices may be adjusted due to raw material costs, supplier pricing, or currency fluctuations. Small-volume orders may be subject to a handling surcharge.
6. Payment Terms
Unless otherwise agreed, payment is due within 30 days of the invoice date (net). Late payments may incur default interest at 5% p.a.
7. Shipping
Unless agreed otherwise, deliveries are ex works (EXW) from the supplier. The customer bears responsibility for transport risks, customs clearance, and insurance. SCSplastic may assist with logistics if requested.
8. Defects & Warranty
Obvious defects must be reported in writing within 8 days of delivery. Hidden defects must be reported within 1 month. For justified claims, SCSplastic will coordinate with the supplier for replacement or repair. SCSplastic is not liable for product functionality or suitability for the customer’s end use.
9. Over-/Under-Delivery
A delivery tolerance of ±10% is considered standard for molded or customized parts, unless explicitly agreed otherwise.
10. Liability Disclaimer
SCSplastic assumes no liability for indirect damage, lost profits, delays, or production defects resulting from third-party manufacturing. Our responsibility lies in project management and problem-solving in collaboration with the client and supplier.
11. Retention of Title
Goods remain the property of SCSplastic or its suppliers until fully paid. Customer-owned molds may not be transferred or removed without prior agreement.
12. Applicable Law & Jurisdiction
Swiss law exclusively applies. Jurisdiction is the competent court in Schwerzenbach, Zurich, Switzerland.
