General Terms and Conditions (AGB)

1. Scope
These General Terms and Conditions apply to all offers, contracts, services, and deliveries provided by
SCSplastic. Any deviations require prior written agreement. Customers accept these terms by placing an
order.
2. Nature of Business
SCSplastic acts as a project-leading service provider, managing and coordinating the development,
production, and delivery of plastic products via partner manufacturers. SCSplastic is not the physical
manufacturer unless explicitly stated.
3. Tooling and Ownership
All tools, molds, and design data produced or developed remain the property of the customer, even when
physically stored at partner factories. SCSplastic ensures proper storage and maintenance but is not liable for
natural wear or damage caused by third parties. Inactive tools may incur maintenance or storage fees after
12 months of non-use.
4. Delivery & Deadlines
Quoted delivery times are approximate and non-binding. Delays caused by force majeure, factory shutdowns,
supplier disruptions, or logistics are not grounds for claims. SCSplastic commits to assisting the customer in
resolving any such delays with the supplier.
5. Pricing
All prices are net, excluding VAT, customs, and shipping unless stated otherwise. SCSplastic reserves the
right to adjust prices due to changes in raw material, supplier rates, or exchange rates. A surcharge may
apply for small-volume orders.
6. Payment Terms
Unless agreed otherwise, invoices are payable within 30 days net from the invoice date. In case of delay,
interest of 5% p.a. may apply.
7. Shipping
Delivery is made ex works (EXW) from the supplier unless agreed otherwise. The customer bears shipping
risks, customs duties, and insurance. SCSplastic supports logistics handling where requested.
8. Defects & Warranty
Claims for visible defects must be made in writing within 8 days of receiving the goods. Non-obvious defects
must be reported within 1 months after delivery. In case of justified complaints, SCSplastic will assist in
coordinating replacement or repair with the manufacturer. No liability is assumed by SCSplastic for product
functionality or end-use suitability.
9. Over-/Under-Delivery
Deliveries may vary up to ±10% of the ordered quantity, especially for custom or molded parts. This is
industry standard unless otherwise agreed in writing.
10. Liability Disclaimer
SCSplastic is not liable for indirect damages, lost profits, delays, or product faults caused by third-party
manufacturing. Our commitment is to project management, supplier coordination, and issue resolution in the
best interest of the client.
11. Retention of Title
Delivered goods remain the property of SCSplastic or its supplier until full payment is received. Molds are
customer-owned but may not be moved without prior agreement.
12. Applicable Law & Jurisdiction
Swiss law applies exclusively. Place of jurisdiction is Böttstein AG, Switzerland.
